Privacy notice

This privacy notice explains how Trinity Church of England School collects, holds, uses and shares personal information relating to pupils and their parents or carers.

Trinity Church of England School is responsible for protecting the personal information we process and ensuring that it is handled in accordance with data protection legislation.

Privacy information for pupils and parents

Information we collect, hold and share

The categories of information relating to pupils and carers that we collect, hold and share include:

  • personal information and contact details, such as name, unique pupil number and address
  • characteristics, such as ethnicity, language, nationality, country of birth and free school meal eligibility
  • attendance information, such as sessions attended, number of absences and absence reasons
  • assessment information
  • relevant medical information
  • special educational needs information
  • exclusions and behavioural information

Why we collect and use this information

We use this information:

  • to support pupil learning
  • to monitor and report on pupil progress
  • to provide appropriate pastoral care
  • to assess the quality of our services
  • to comply with the law regarding data sharing

The lawful basis on which we use this information

We collect and use information under Article 6 (1)(e) of the UK GDPR, where processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

We process special category data under Article 9 (2)(b) of the UK GDPR where processing is necessary for carrying out obligations and exercising specific rights of the data controller.

Collecting information

Whilst the majority of information you provide to us is mandatory, some information is provided on a voluntary basis.

To comply with data protection legislation, we will tell you whether you are required to provide particular information or whether you have a choice.

How long we keep information

We currently hold pupil data for the following periods:

  • Primary: for as long as the child attends the school
  • Secondary: until the child turns 25

Who we share information with

We routinely share information with:

  • schools that pupils attend after leaving Trinity
  • our local authority, the London Borough of Lewisham
  • the Department for Education
  • academy chains
  • federations or Multi Academy Trusts
  • the school nurse and NHS

We do not share information with anyone without consent unless the law and our policies allow us to do so.

We share pupil data with the Department for Education on a statutory basis. This data sharing underpins school funding and educational attainment policy and monitoring.

We are required to share information about our pupils with our local authority and the Department for Education under section 3 of The Education (Information About Individual Pupils) (England) Regulations 2013.

Data collection requirements

The Department for Education places data collection requirements on schools, including through the school census.

Youth support services

Pupils aged 13+

Once pupils reach the age of 13, we also pass pupil information to our local authority and/or provider of youth support services as they have responsibilities in relation to the education or training of 13 to 19 year olds under section 507B of the Education Act 1996.

This enables them to provide:

  • youth support services
  • careers advisers

A parent or guardian can request that only their child’s name, address and date of birth is passed to the local authority or provider of youth support services by informing us. This right transfers to the pupil once they reach the age of 16.

Pupils aged 16+

We also share certain information about pupils aged 16 and over with our local authority and/or provider of youth support services because of their responsibilities in relation to the education or training of 13 to 19 year olds under section 507B of the Education Act 1996.

This enables them to provide:

  • post 16 education and training providers
  • youth support services
  • careers advisers

The National Pupil Database

The National Pupil Database is owned and managed by the Department for Education and contains information about pupils in schools in England.

It provides evidence on educational performance to inform independent research and studies commissioned by the Department. It is held electronically for statistical purposes and information is securely collected from sources including schools, local authorities and awarding bodies.

We are required by law to provide information about our pupils to the Department for Education as part of statutory data collections such as the school census and early years census. Some of this information is then stored in the National Pupil Database.

The Department may share information from the National Pupil Database with third parties who promote the education or wellbeing of children in England by:

  • conducting research or analysis
  • producing statistics
  • providing information, advice or guidance

The Department has processes and controls in place governing access to and use of this information.

CCTV

For your safety, we record CCTV in the school grounds. CCTV recordings are kept for three months.

Under data protection legislation, parents and pupils have the right to request access to footage of themselves.

Under data protection legislation, parents and pupils have the right to request access to information about them that we hold.

You also have the right to:

  • object to processing of personal data that is likely to cause, or is causing, damage or distress
  • prevent processing for the purpose of direct marketing
  • object to decisions being taken by automated means
  • in certain circumstances, have inaccurate personal data rectified, blocked, erased or destroyed
  • claim compensation for damages caused by a breach of data protection regulations
